1. Acceptance of Terms

By registering for, accessing, or using the Zestful Amigos mobile application, website, or any related services (collectively, the "Platform"), you ("User," "you," or "your") agree to comply with and be bound by these Terms and Conditions, our Privacy Policy, and our Refund Policy.

If you do not agree with any part of these Terms, you must not use the Platform. Your continued use of the Platform following any amendments to these Terms constitutes acceptance of those changes.

2. Definitions

• "Zestful Amigos," "we," "us," or "our" refers to Zestful Amigos , a company incorporated under Indian law.
• "Platform" refers to the Zestful Amigos mobile application, website (zestfulamigos.app), and all associated services.
• "User" refers to any individual who registers to book companion services through the Platform.
• "Companion" refers to any verified individual who registers to offer companionship services through the Platform.
• "Session" refers to a confirmed, paid interaction between a User and a Companion facilitated through the Platform.
• "Booking" refers to the reservation and payment transaction made by a User to engage a Companion for a Session.

3. Eligibility

To use the Zestful Amigos Platform, you must:

• Be at least 18 years of age.
• Have the legal capacity to enter into a binding contract under applicable law.
• Provide accurate, current, and complete information during registration.
• Not be barred from using the Platform under applicable law.
• Complete identity verification as required by Zestful Amigos.

Zestful Amigos reserves the right to refuse registration or revoke access to any individual who does not meet these criteria, or whose conduct is contrary to our community standards.

4. Our Services

Zestful Amigos is a technology platform that facilitates connections between Users seeking social companionship and verified Companions willing to provide it. We are a marketplace and intermediary — not a party to the companionship relationship itself.

What We Provide:

• A discovery platform to find and connect with verified Companions
• Secure, escrow-based payment processing
• In-app encrypted messaging between Users and Companions
• Live location sharing infrastructure for safety monitoring
• SOS emergency response system
• Curated safe meeting location recommendations
• A mutual rating and review system
• 24/7 safety team monitoring during active Sessions

5. User Obligations

As a User, you agree to:

• Provide truthful information during registration and verification.
• Treat Companions with dignity, respect, and professionalism at all times.
• Not request, expect, or accept any services beyond the agreed social companionship scope.
• Share your live location with the Zestful Amigos safety team as required during active Sessions.
• Use the SOS button in case of any emergency.
• Pay the agreed booking amount in full prior to Session commencement.
• Report any inappropriate conduct by a Companion through the in-app reporting system.
• Not attempt to contact, solicit, or arrange meetings with Companions outside the Platform.

6. Companion Registration & Obligations

To register as a Companion, you must complete our multi-step verification process, including government ID verification, biometric photo match, background check, and a safety interview. Approval is at Zestful Amigos's sole discretion.

As a Companion, you agree to:

• Maintain complete honesty in your profile, including availability and services offered.
• Only accept bookings you are genuinely able and willing to fulfil.
• Arrive punctually at the agreed meeting location.
• Share your live location with the Zestful Amigos safety team during all active Sessions.
• Maintain a professional and respectful demeanour at all times.
• Not engage in, encourage, or permit any romantic, sexual, or inappropriate interaction.
• Report any inappropriate behaviour by a User immediately through the Platform.
• You understand that you operate as an independent contractor, not an employee of Zestful Amigos.

7. Bookings, Payments & Fees

Payment Processing

All payments are processed through our secure third-party payment gateway. Funds are held in escrow by Zestful Amigos until a Session is confirmed complete by both parties.

Platform Fee

Zestful Amigos retains 5% of the total booking amount as a platform service fee. Companions receive 95% of the agreed booking amount, paid within 2–3 business days of Session completion.

Cancellations

• If a Companion does not accept a booking within 15 minutes, the User receives a full refund.
• Cancellations by the User more than 2 hours before the Session: full refund.
• Cancellations by the User within 2 hours of the Session: 50% refund.
• No-shows by the User: no refund.
• Cancellations by the Companion after acceptance: User receives a full refund.

8. Safety Requirements

The safety of all parties is paramount. During any active Session:

• Both User and Companion are required to enable live location sharing with Zestful Amigos's safety team.
• The SOS button must remain accessible at all times.
• Meetings must take place at Zestful Amigos-approved public locations only.
• All communication must occur through the in-app messaging system until the Session commences.

Failure to comply with safety requirements may result in Session cancellation without refund and suspension of your account.

9. Prohibited Conduct

The following conduct is strictly prohibited on the Platform and will result in immediate account termination:

• Soliciting, engaging in, or facilitating romantic, sexual, or intimate activities of any kind.
• Harassment, threats, abuse, or intimidation of any other user.
• Providing false information during registration or verification.
• Attempting to circumvent Platform fees by arranging off-platform bookings.
• Sharing personal contact information (phone number, social media) before a Session is confirmed.
• Meeting at unapproved, private, or residential locations for first Sessions.
• Discriminating against others on the basis of gender, caste, religion, nationality, or disability.
• Creating multiple accounts or impersonating another individual.
• Using the Platform for any illegal purpose under applicable Indian law.

10. Privacy

Your use of the Platform is subject to our Privacy Policy, which is incorporated into these Terms by reference. We collect, process, and protect your personal data in accordance with applicable data protection laws, including the Digital Personal Data Protection Act (DPDPA), 2023.

11. Limitation of Liability

Zestful Amigos is a marketplace platform. We do not guarantee the conduct, quality, or suitability of any Companion or User. To the maximum extent permitted by law:

• We are not liable for any direct, indirect, incidental, or consequential damages arising from use of the Platform.
• Our total liability to you for any claim shall not exceed the amount paid by you for the booking in question.
• We do not warrant that the Platform will be uninterrupted, error-free, or completely secure.

Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud, or any liability that cannot be excluded by law.

12. Termination

Zestful Amigos may suspend or terminate your account at any time, with or without notice, for any violation of these Terms, applicable law, or our community standards. You may also delete your account at any time through the Platform settings.

Upon termination, all pending bookings will be cancelled and refunds processed in accordance with our Refund Policy. Certain provisions of these Terms (including intellectual property, limitation of liability, and governing law) will survive termination.

13. Governing Law & Disputes

These Terms are governed by and construed in accordance with the laws of India. Any dispute arising from or in connection with these Terms shall first be attempted to be resolved through good faith negotiation. If unresolved, disputes shall be subject to the exclusive jurisdiction of the courts of Bengaluru, Karnataka, India.
